“FOX 6 and Toyota Salute to Veterans – 2018 RAV4 Giveaway” Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. Purchases do not increase the chances of winning.

1.  Eligibility:  Entrants (the person submitting a name for selection in the contest) and the person or family nominated for the prize (“Nominee”) must be legal U.S. residents, at least 21 years old, residing in one of the following Wisconsin counties: Dodge, Jefferson, Kenosha, Milwaukee, Ozaukee, Racine, Sheboygan, Walworth, Washington Waukesha (the “FOX6 Viewing Area”). Nominees who meet the definition of “veteran” as determined by the U.S. Department of Veterans Affairs are eligible to enter. Additionally, a veteran on active duty in the Armed Forces whose home is in the FOX6 Viewing Area is also eligible. Finalists must show proof of military service to FOX6 (copy of active duty orders, their DD 214 or WD55 papers) on or before February 21, 2018; failure to do so may result in disqualification of the finalist and selection of another Nominee as a finalist. An Entrant or Nominee is ineligible if the Entrant or Nominee, or a member of Entrant’s or Nominee’s immediate family living in the same household has won a prize from WITI since November 11, 2017. Employees of WITI FOX6, the Chicago Region Toyota Dealers Association, Toyota Motor Sales, U.S.A., Inc., those entities’ advertising agencies, or any of the aforementioned entities’ affiliates or subsidiaries, nor a member of such employee’s immediate family living in the same household, are not eligible to participate or win. The six finalists, and/or their family member(s) will be required to show proof of service (copy of active duty orders, their DD 214 or WD55 papers) on or before February 21, 2018.  Failure to provide proof of service will result in the potential disqualification of the veteran (or veteran’s family) from the contest. Sponsors reserve the right to obtain civil, criminal, financial, driver-history and any other type of background check deemed necessary in connection with any Entrant or Nominee.

2.  Contest period:  The Contest entry period begins on Monday, February 5, 2018 at 4:00 AM CST, and ends on Thursday, February 15, 2018 at 11:59 PM CST (“Entry Period”).

3.  To Enter:  Entrants must visit the FOX6Now.com contest page during the Entry Period and follow the contest link. Entrant must complete the contest entry form in its entirety, including the Entrant’s name, address, phone number and email address. The entrant should nominate a veteran or the family of a veteran, with a picture of the veteran or veteran’s family and a short essay of 150 words or less on why the veteran or veteran’s family (Nominee) is deserving of the contest Grand Prize. The full name and age of the veteran must be provided. Nominations must be received by the end of the Entry Period. Incomplete entries will not be considered. Limit one entry per person and per email address.

4.  Selection of Winners:  All entries will be reviewed at the end of the Entry Period, and six (6) finalists will be selected by a panel of FOX6 judges. The judges will select the six finalist entries from among all valid entries received based on receiving the highest scores pursuant to the following criteria:    50% - quality of essay; and 50% - potential marketing and/or entertainment value of an entrant's submission. Names of the finalists may be posted on fox6now.com following selection. The Grand Prize event will take place on February 28, 2018 from between 3:15 and 5 p.m., live on FOX6 at the Greater Milwaukee Auto Show. Each of the finalists will select a sealed envelope at random. One of the envelopes will contain a congratulations letter. The finalist who selects the congratulations letter will be declared the Grand Prize winner, subject to verification of eligibility. To be eligible to win, each finalist must be present for the live selection of the winner. If the finalist cannot be present, he/she will be disqualified and another Nominee will be selected from the entries as a finalist. Finalists’ odds of winning are 1 in 6.

5.  Grand Prize. One prize, the Grand Prize, will be awarded. The Grand Prize is a 2018 Toyota RAV4 XLE AWD SUV.  Approximate retail value is $30,302. Winner will have the opportunity to select interior and exterior color. The Grand Prize will be delivered to the winner when available, at a Toyota dealer in the FOX6 Viewing Area selected by agreement of FOX6, Toyota and the winner. The winner must provide proof that he/she is a licensed driver and has liability insurance required by state law in order to receive the Grand Prize.  Any additional options not specified herein are subject to availability and at the sole discretion of the Chicago Region Toyota Dealers Association.  BE AWARE THAT INCOME TAXES ON THE GRAND PRIZE WILL, IN ALL LIKELIHOOD, BE SUBSTANTIAL.  DO NOT ENTER THIS CONTEST IF YOU ARE NOT PREPARED TO PAY INCOME TAXES ON THE GRAND PRIZE. 

6.  Conditions of Entry: By participating in the contest, each Nominee irrevocably agrees that if selected as a finalist:

            (a)        The Nominee is eligible in accordance with these Rules and agrees to be bound by and comply with the Rules and the decisions of the Sponsors, whose decisions will be final and binding on all matters and disputes related to the contest. 

            (b)        Sponsors may use any information related to the contest, including personal information in entries, for marketing or any other lawful purpose. The contest is subject to WITI’s privacy policy, http://fox6now.com/privacy-policy.

            (c)        Sponsors will have the right to use and authorize the use of each finalist’s name, likeness, photograph, voice, and/or hometown, for any purpose, including publicity, promotion and advertising, worldwide in any media (including without being limited to the Internet and television), in perpetuity, without compensation, credit or the right to review or approve.

            (d)        Entrants release, discharge, and will hold harmless WITI License, LLC, WITI, LLC, the Chicago Region Toyota Dealers Association, Toyota Motor Sales, U.S.A., Inc., their respective affiliates, parents, subsidiaries, advertising and promotion agencies, and the officers, directors, employees, representatives, and agents of each of them (“Released Parties”) from all liability, injuries, losses, costs or damages of any kind or nature, to persons or property, in any way connected with the Contest, the prizes, or the Entrant’s receipt or use of a prize. UNDER NO CIRCUMSTANCES WILL THE RELEASED PARTIES BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES, ATTORNEYS’ FEES, OR ANY OTHER DAMAGES OF AN ENTRANT, WHETHER OR NOT SUCH DAMAGES WERE FORESEEABLE. 

6.  Taxes:  All federal, state, and local income taxes are the sole responsibility of the Grand Prize winner. (If the winner is a veteran’s family, the family member who accepts the prize will be deemed the Grand Prize winner for tax purposes.) The Grand Prize winner will receive an IRS Form 1099 reflecting the value of the prize.  WITI will report the value of the prize (vehicle plus tax, title, license fees) to the IRS by way of the IRS Form 1099.

7.  Other Rules:

            (a)        This contest is void where prohibited, and is subject to all federal, state, and local laws and regulations. It is governed by Wisconsin law.

            (b)        ANY ATTEMPT TO DELIBERATELY CIRCUMVENT, DISRUPT, OR DAMAGE THE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST, IS A VIOLATION OF CRIMINAL AND CIVIL LAW.  SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW AND TO DISQUALIFY ANY SUCH INDIVIDUAL FROM PARTICIPATION IN THE CONTEST OR ANY OTHER SPONSOR PROMOTIONS.

            (c)        Sponsors may temporarily postpone or discontinue the Contest at any time without prior notice, in their sole discretion. Sponsors also reserve the right, in their sole discretion, to cancel, terminate, modify or suspend the Contest or any portion thereof, or to disqualify any individual implicated in any of the following actions: (i) infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes which, in Sponsors’ sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, (ii) the Contest or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper processing of entries per these Rules, or (iii) the contest is otherwise not capable of running as planned. 

            (d)        Any entrant who attempts to tamper with this Contest in any way or use fraudulent means to participate in and/or win the Contest shall be disqualified. Sponsors may disqualify any entrant for language, activities or behavior they deem inappropriate. 

            (e)        The Grand Prize is not transferable, and has no cash value. Sponsors reserve the right to substitute a prize of equal or greater value solely at their discretion.

            (f)        Sponsors will have no responsibility or liability whatsoever for any property loss, damage, personal injury, or death, in connection with the Grand Prize or any person’s participation in the contest. The Grand Prize vehicle will be subject to the express written limited warranties specifically set forth in the applicable Owner's Guide for the Grand Prize vehicle. The Prize Vehicle will be delivered solely with the express written limited warranties set forth in the Prize Vehicle’s applicable Owner's Guide, which warranties shall run for the term set forth in said Guide. WITI FOX6 will have no liability under such manufacturer’s warranties.

            (g)        The depiction of the Grand Prize vehicle in any advertising or promotional materials or physical displays may not reflect the actual Grand Prize vehicle delivered to the winner.

            (h)        The Grand Prize winner must execute and notarize an affidavit of eligibility and liability/publicity release and return such affidavit to WITI FOX6 and/or designated Toyota representative before accepting delivery of the Grand Prize vehicle. Failure to do so may result in the Grand Prize being forfeited and awarded at random to another finalist.

            (i)         The Chicago Region Toyota Dealers Association will be responsible for taxes associated with the sale of a motor vehicle (specifically excluding the winner’s income taxes incurred from acceptance of the Grand Prize, which are the sole responsibility of the winner), license, title and registration fees or other costs, including without limitation any reasonable and agreed travel or transportation costs, associated with transferring and/or winning of the Grand Prize vehicle.

            (j)         Sponsors will not be responsible for delays beyond their control in delivery of the Grand Prize vehicle, which may take as much as six months following receipt of all qualifying information from the winner. If, for reasons beyond their control, the Grand Prize vehicle cannot be delivered, Toyota may select another year and/or model vehicle of equal or greater value, which will be substituted for the Grand Prize. The winner shall bear all risk of loss or damage to the Grand Prize vehicle after it has been delivered to the winner.  The winner must personally retrieve the Grand Prize vehicle within thirty (30) days of written notification of delivery.

Green Bay Rd., Milwaukee, WI 53209, until March 23, 2018. Rules are also available from 7:00am to 4:00pm weekdays at WITI’s business offices, or online at www.FOX6Now.com. For the name of the Grand Prize winner, send a separate, self-addressed, stamped envelope to FOX 6 and Toyota Salute to Veterans – 2016 RAV4 Giveaway” Winner List, WITI, 9001 N. Green Bay Rd., Milwaukee, WI 53209, after March 4, 2018 and before May 19, 2018.
