WITI Future Forecasters Video Contest
Official Rules
NO PURCHASE NECESSARY TO
ENTER OR WIN. THIS IS NOT AN OFFER OF,
OR SOLICITATION FOR, EMPLOYMENT.
1.
Eligibility: Contestants must be legal US residents, at least 18 years old,
and reside in the Milwaukee Designated Market Area as defined by The Nielsen
Company. The Child must also meet the above residency requirements. Contestants must be the parent or legal guardian
of the child depicted in the video submitted (the “Child”). Void where
prohibited and outside the area set forth above. Employees of WITI Television,
LLC (the “Sponsor”), Tribune Media Company, and their respective affiliates,
parents, subsidiaries, promotional agencies, and advertising agencies,
employees of other television or radio stations, and members of the immediate
families of such persons are not eligible to participate and win. The term
“immediate family” includes spouses, siblings, parents, children, grandparents
and grandchildren, and any other person residing at the same household whether
or not related. Winning a prize is contingent upon fulfilling all requirements
set forth herein.
2.
Contest Period: The
Contest begins at 4:30am CT on November 10, 2014 and will continue indefinitely until Sponsor posts notice on its FOX6now.com
Future Forecaster webpage indicating the date the promotion ends (the “Contest
Period”).
3.
Contest Entry: To enter, visit
the FOX6Now.com Future Forecaster page and complete the entry form, including
the submission of the Child’s audition video.
Sponsor’s webpage will explain the procedure for how to upload the video
to the contest entry site. Video must show the Child giving a pretend
weather forecast. To be eligible, all entries must be submitted by the close of
the Contest Period. All Videos must be in English and no more than 1 minute, 30
seconds in length. The Video may not depict anyone who is not your child or legal
ward, and the Child must be no younger than six years old and no older than 12
years old as of the date the video is submitted. Incomplete
entries will be disqualified. Entries must include Child’s Name, Parent/Legal Guardian’s Name,
Daytime phone number, Evening phone number, Parent’s email address, Address,
City, State, Zip, Name of Child’s school, Child’s grade in school, Child’s age
and upload of Child’s video audition. Contestants
must use their own name and current residential address. Sponsor will use all
information submitted in entries in accordance with its Privacy Policy, which
is located at http://privacy.tribune.com/. Limit one entry per contestant per
year.
4.
Other Conditions of Entry: By
entering, each contestant represents and warrants that the contestant is the
parent or legal guardian of the Child, no laws were broken in the creation of
the Video and that the Video is his/her own original creation, the contestant
has all rights necessary to submit the Video, the Video has not been copied in
whole or in part from any other work, the Video does not violate the rights of
any person or entity (including but not limited to privacy rights, trademarks,
and copyrights), the Video does not defame, libel, or slander anyone or any
entity, and does not contain inappropriate, offensive, indecent, vulgar,
obscene or profane content. Entries that
do not comply with these Official Rules or the foregoing representations and
warranties may be disqualified. Each contestant agrees to indemnify, defend and
hold Sponsor harmless against any and all liabilities, losses, damages, claims,
debts, investigations, fines, penalties, costs, expenses and settlements
(including attorneys' fees and costs of litigation, settlement, judgment,
interest and penalties) arising out of or related to a breach of the foregoing
representations and warranties. By entering, each contestant grants to the
Sponsor a world-wide, perpetual, non-revocable, royalty-free license to publish,
display, and distribute his/her Video and a video of the Appearance (as defined
below) as well as derivative works based thereon on WITI, on the WITI website, and
through any and all other media, now known or hereafter devised, in any manner
related to the Contest, without prior notice, approval or compensation.
Contestants otherwise will retain all rights to their respective Videos.
5.
Winner Selection: Sponsor will select
winners based on child’s performance, enthusiasm, love of weather and on-camera
presence. First winner will be selected on or around December
5, 2014 from entries received prior to that date. Additional winners will be selected
periodically thereafter. All entries received from the beginning of the contest
period to the current date will be considered for each drawing. Deadline for submission of entries will be
announced on WakeUp News and/or posted on the website.
6.
Winner Notifications: Sponsor will attempt to notify the Contest
winners by
phone and/or email, and Sponsor may also announce Contest winners on-air and/or
also on the Future Forecasters web page. Winners must have a valid phone number where he/she can be notified. If
a winner is unreachable after two days, or if that winner is unavailable for
prize fulfillment, Sponsor reserves the right to disqualify the selected winner
and award the prize to another winner by selecting the next best Video, as
determined by the Sponsor, from all entries received to date. All results are
unofficial until winners are verified.
7.
Prizes: Each prize is the opportunity to have your
Child appear live on a Friday morning “Future Forecaster” segment on the Fox 6 Wake-Up
News (the “Show”) between 7 a.m. and 8 a.m. (the “Appearance”) live from the
Fox 6 studios, 9001 N. Green Bay Road, Milwaukee, WI 53209. The Appearance may also appear on the Fox 6
website.. Winners do not receive cash or merchandise. Child must be willing to appear on the Show,
or winner will be disqualified. Sponsor will attempt to give winner
approximately two weeks advance notice of the Appearance, and winner and Child
must arrive at the station by no later than 7 a.m. on the date of the Appearance.
The parent/legal guardian must accompany the Child at all times during the Appearance.
The parent/legal guardian is also responsible for transporting child to and
from the Fox 6 studios. If winner and/or Child are unavailable on the
designated date or are late for the Appearance, prize will be forfeited, and no
alternate prize will be awarded. Please note that if there is severe weather or
breaking news, the Future Forecaster segments may be cancelled or rescheduled. Sponsor will attempt to notify winner in
advance. Prizes cannot be
redeemed for cash or substituted for any other items. Prizes are non-assignable
and non-transferrable. Sponsor reserves the right to substitute a comparable
prize of like or greater value for the prize, for any reason. Costs of
transportation and accommodations, where applicable and any other cost or
services not specifically included in the prize are the sole responsibility of
the winners. The opportunity to appear on the Show is not an offer of
employment, and winner represents and warrants that Child’s Appearance on the
Show will not violate any union or guild agreement.
8.
Prize Acceptance: Only one entry per child per year. Child may only win one time over the course
of the contest. Winners are subject to
verification by Sponsor for compliance with these rules. Winners may be
required to sign an Affidavit of Eligibility/Release of Liability and Publicity.
Failure to do so will disqualify the
winner. If a winner is disqualified, Sponsor reserves the right to determine an
alternate winner or to not award the prize at all.
9.
Publicity Release: By participating in the Contest, each contestant
acknowledges that his/her entry in the Contest constitutes that contestant’s
consent to use, publish, reproduce and for all purposes, including publicity,
promotion and advertising, in any media (including without limitation, the
Internet, television or offline promotions), the following for his or her Child
depicted in the Video: name,
likeness, portrait, recorded voice and biographical material without limitation
and without the payment of additional compensation to the contestant or the
Child, in order to advertise, promote or publicize the Sponsor and the contest,
but not, however, as an endorsement of any institutions, product or service of
any advertiser.
10.
Disclaimer: Sponsor is not responsible for
mechanical, technical, computer, hardware or software errors, malfunctions, or
failures of any kind, including but not limited to failed, incomplete, garbled,
or delayed transmission of entries, traffic congestion, viruses, sabotage,
satellite failures, electrical outages, on telephone lines, on the Internet, at
any website, or application or lost or unavailable network connections or
natural disasters or acts of God or man, which may limit a contestant’s ability
to participate in the Contest, and any injury or damage to contestant’s or any
other person’s computer related to or resulting from participating in,
uploading or downloading any information necessary to participate in the Contest.
ANY ATTEMPT BY A CONTESTANT TO
DELIBERATELY CIRCUMVENT, DISRUPT, OR DAMAGE ORDINARY AND NORMAL OPERATION OF
THIS CONTEST, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST WILL
DISQUALIFY ANY SUCH INDIVIDUAL FROM PARTICIPATION IN THE CONTEST OR ANY OTHER CONTEST.
11.
Conditions: By entering, contestants represent
that they are eligible and agree to be bound by and comply with the Rules and
the decisions of the Sponsor, which are final, binding and incontestable on all
matters pertaining to the Contest. Any contestant who attempts to tamper with
this Contest in any way or use fraudulent means to participate in and/or win
the Contest will be disqualified. Sponsor reserves the right to disqualify any contestant
at any time, for reasons, including without limitation, language, activities or
behavior deemed inappropriate. Sponsor is not responsible for cancellations,
postponements, or delays beyond their control. Other than the prize received by
the winner, no contestant or Child will be entitled to receive any wages,
benefits, fees or other compensation whatsoever as a result of participating in
or winning the Contest. Sponsor has the sole discretion to administer the Contest
and interpret and apply the Rules.
12.
Indemnification/Hold Harmless: By participating, contestants agree on
behalf of themselves and the Child depicted in the Video: (a) to the Rules and
decisions of Sponsor; (b) to release, discharge, and hold harmless Sponsor, and
all of their respective affiliates, parents, subsidiaries, advertising and
promotion agencies and all of their officers, directors, employees,
representatives, and agents (the “Released Parties”) from all liability,
injuries, losses or damages of any kind to persons, including but not limited
to invasion of privacy (under appropriation, intrusion, public disclosure of
private facts, false light in the public eye or other legal theory),
defamation, slander, libel, violation of right of publicity, infringement of
trademark, copyright, or other intellectual property rights, death or property
damage resulting in whole or in part, directly or indirectly, from the acceptance,
delivery, possession, misuse or use of a prize (including any travel or
activity related thereto), or from participation in and/or entry into or
creation of an entry for the Contest and/or the broadcast or exploitation or
use of entry or any other Contest-related activity; and (c) that the Released
Parties have neither made nor are in any manner responsible or liable for any
warranty, representation or guaranty, expressed or implied, in fact or in law,
relating to any prize. In consideration for his or her participation in the Contest,
each contestant agrees on behalf of himself or herself and on behalf of the Child
depicted in the Video to hold harmless and indemnify the Released Parties from
any and all claims, demands and/or causes of action of any nature or kind
whatsoever, whether presently known or unknown, foreseen or unforeseen, that
arise out of the contestant’s participation in the Contest, including
attorneys’ fees.
13. Limitation of Liability: The Released Parties are not
responsible or liable for: (a) any incorrect or inaccurate entry information or
other errors in the printing, offering or administration of the Contest or in
the announcement of the prize(s), (b) theft or destruction of, tampering with,
unauthorized access to, or alteration of entries and/or entry information, (c)
entries that are late, lost, stolen, damaged, incomplete, postage-due, illegible,
and/or unintelligible (or any combination thereof), or (d) any change of email
address, mailing address, telephone number and/or any other contact information
provided by contestant. Any expenses incurred by the contestant during the entry
process are the sole responsibility of each contestant and the Sponsor will not
issue reimbursement for any expenses. Neither the failure of Sponsor to insist
upon or enforce strict performance of any provision of these Official Rules nor
the failure, delay or omission by Sponsor in exercising any right with respect
to any term of these Official Rules, will be construed as a waiver or
relinquishment to any extent of Sponsor’s right to assert or rely upon any such
provision or right in that or any other instance. UNDER NO CIRCUMSTANCES WILL
THE RELEASED PARTIES BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL
OR EXEMPLARY DAMAGES, ATTORNEYS’ FEES, OR ANY OTHER DAMAGES WHETHER OR NOT SUCH
DAMAGES WERE FORESEEABLE.
14.
Choice of Law/Forum: Wisconsin law will govern this Contest,
without regard to Wisconsin’s choice of law rules. The courts of Wisconsin will
be the exclusive forum for any dispute regarding any Rule or activity
associated with the Contest.
15.
Names of Winners: For a list of prize winners, send a
separate, self-addressed, stamped envelope to WITI Television, LLC, located at 9001
North Green Bay Road, Milwaukee, WI 53209 Requests must be received during the Contest
Period or by two months after the Contest Period ends.
